Virginia Distracted Driving Accident Attorneys

Trust Your Case to a Team with Proven Results

Distracted driving is an epidemic on our roads. According to the Department of Transportation, in 2011, over 3,000 people were killed by distracted drivers. The National Safety Council also estimates that 25% of all crashes can be attributed to someone either talking on a cellphone or texting while driving.

Distracted driving is a leading factor in many motor vehicle accidents. In fact, distracted drivers have been shown to have slower reaction times than a drunk driver. In response to this epidemic, many states, including Virginia, have implemented a law prohibiting the use of a cell phone to text while on the road.

While technology makes up a large percentage of distractions in distracted driving cases, it is not the only culprit. At Breit Cantor Grana Buckner, we believe that you shouldn’t have to pay for your injuries due to another individual’s recklessness—that’s been our stance since 1979. Our Virginia distracted driving accident attorneys can represent your rights and help you pursue just compensation after a distracted driving accident. With more than 300 years of combined experience and hundreds of millions recovered on behalf of our clients, our attorneys are prepared to fight for you. We represent injured individuals and their families in Virginia Beach, Richmond, Hampton Roads, and throughout the state.

Understanding the Different Types of Distracted Driving

Distracted drivers are all around us and represent one of the most dangerous threats to safety on the road. Distracted driving can be divided into four categories: physical distractions, visual distractions, audible distractions, and cognitive distractions.

Examples of each type of distracted driving include:

  • Physical distractions are driver distractions in which the driver removes his or her hands from the steering wheel. Such distractions include changing the radio station, eating while driving, or even applying makeup while driving.
  • Visual distractions are distractions that divert a driver’s vision from the road, such as reading while driving, texting while driving, or looking down to change the radio station.
  • Audible distractions are sounds that take a driver’s time and attention from the road, such as ongoing conversations with passengers or loud stereo music.
  • Cognitive distractions are things that require a driver to think about things other than driving. Cognitive distractions are often the most overlooked driver distractions. For example, talking on a cellphone by using a hands-free device is considered by many to be a safer alternative to driving while talking on a hand-held device. More and more traffic studies, however, debunk this myth by finding that talking on a cellphone while driving, even with a hands-free device is just as distracting and dangerous as driving while talking into the device directly.

The bottom line is there are virtually unlimited causes for distracted drivers, making travel on the roadways more dangerous than ever.

How to Avoid Distracted Driving

Some key tips for doing your part to make the roads safer include:

  • Minimize distractions before starting your car. Take care of potential driver distractions before putting your vehicle in motion. Get directions ahead of time.
  • Send any important emails and return last minute calls before starting your car. Make sure child passengers are buckled in and have any books, games, or other forms of entertainment before you get on the road.
  • Only answer important calls while driving and keep the duration of any conversation to an absolute minimum. Also, be sure people are aware of your desire not to talk during times you are on the road. This will eliminate those calls from friends during the rush hour commute, which is when traffic volume is highest and distractions must be avoided at all costs.
  • Never text while driving. Even though texting and driving is illegal in Virginia, it still falls into almost every driver distraction category and is among the most hazardous of all driver distractions. Avoid reading or sending texts while driving at all costs.
  • Do not eat while driving. This sounds simple, but how many times have you seen someone wrestling with a fast food bag while driving?

At Breit Cantor, we have handled thousands of personal injury cases arising out of automobile collisions. Many are collisions caused by distracted drivers. We understand how driver distractions cause accidents, and we know how to gather the evidence necessary to prove it.
